Can a photograph be notarized?

To make it legally binding, a Notary Public’s signature and seal must appear on a notorial certificate such as an acknowledgement or a jurat and it must then be accompanied by a written statement signed by another person. What happens when identifying documents are not available?

When a signer is unable to produce acceptable means of identification, he or she may still be identified on the oath or affirmation of one or two credible witness(es).
The law states that —
– If two credible witnesses are available to identify the signer of the document(s) presented to the Notary Public, each of them must personally know the signer of the said document(s) and they must both have acceptable IDs.
– If only one credible witness is available to identify the signer of the document(s) presented to the Notary Public, the Notary Public must personally know the witness and the witness much personally know the signer of the document(s).
– A credible identifying witness must not have an interest, or be named, in the document(s) presented to the Notary Public for notarization.
– A credible identifying witness must be aware of the fact that the signer of the document(s) presented to the Notary Public does not have an acceptable ID and that it would be impractical to obtain one at that time. (Civil Code, Section 1185).

What are acceptable Identification Documents (IDs)?
Answer:
Acceptable IDs are means by which the Notary Public in the State of California identifies the signer of document(s) presented. Providing that they are current, the following are acceptable IDs —
– California driver’s license or a non-driver’s ID issued by the DMV.
– Driver’s license or a non-driver’s ID issued by another U.S. State.
– Driver’s license issued in Mexico or Canada.
– U.S. Passport.
– Foreign passport stamped by the U.S. Citizenship & Immigration Services (USCIS).
– U.S. military ID that includes all required information. The Common Access Card (CAC) is not acceptable as a means of identification for notarization by California Notary Publics.
– Inmate ID issued by the CDC is acceptable as a means of identification of prisoners that are presently in custody.
– ID card issued by the U.S. Citizenship and Immigration Services is acceptable as a means of identification only for notarization of USCIS forms.
